The
Scottish Law Commission has published a discussion paper on third party rights in contract: see
here. The Commission seeks views on whether a short legislative statement should be introduced, in place of the current common law, setting out how third parties can have rights and remedies conferred upon them under a contract between other parties. Several issues relating to corporate groups are considered in the discussion paper (see paragraphs 3.4 to 3.19).
