The Royal Court (Samedi Division) has, for the first time, given directions under a power given to it by article 46 the Foundations (Jersey) Law 2009: see A Ltd. v B Ltd and others [2013] JRC075. In doing so it has provided some important analysis of the scope and operation of article 46 and of the differences between trusts and foundations.
