
The
Financial Law and
Company Law Committees of the
City of London Law Society have published a
memorandum in which they explain the company law principles to take into account where a transaction involves a private company providing financial assistance for the purchase of its own shares. With effect from 1 October 2008, the giving of such financial assistance by a private company will no longer be unlawful - see
here for further information - but, as the
memorandum explains, other company law matters remain relevant.
