
The High Court gave judgment today in
Parry v Bartlett [2011] EWHC 3146 (Ch) and granted permission to continue a derivative claim under
Part 11 of the
Companies Act (2006) in respect of alleged breaches of directors' duties. The case was, in the view of the trial judge, a classic case for a derivative claim (and would have been so under the common law framework which was in place prior to Part 11).
