Last week the Law Commission published its report Review of the Law of Trusts: A Trusts Act for New Zealand: see here. The Commission recommends that the Trustee Act 1956 should be replaced by a new Trusts Act in order to modernise the law. Over fifty recommendations are made, including placing on a statutory footing the duties of trustees and the circumstances in which they can be avoided.
